{"id":8840,"date":"2026-07-17T18:30:44","date_gmt":"2026-07-17T13:30:44","guid":{"rendered":"https:\/\/usnews-14267fa.ingress-comporellon.ewp.live\/?p=8840"},"modified":"2026-07-17T18:30:44","modified_gmt":"2026-07-17T13:30:44","slug":"trump-administration-sues-to-stop-maryland-from-giving-in-state-tuition-to-illegal-immigrants","status":"publish","type":"post","link":"https:\/\/usnews-14267fa.ingress-comporellon.ewp.live\/?p=8840","title":{"rendered":"Trump administration sues to stop Maryland from giving in-state tuition to illegal immigrants"},"content":{"rendered":"<p><script>\r\n  atOptions = {\r\n    'key' : '644b717812d811d6a1c1fc5b6ccd6fa6',\r\n    'format' : 'iframe',\r\n    'height' : 90,\r\n    'width' : 728,\r\n    'params' : {}\r\n  };\r\n<\/script>\r\n<script src=\"https:\/\/www.highperformanceformat.com\/644b717812d811d6a1c1fc5b6ccd6fa6\/invoke.js\"><\/script>\r\n<br \/>\n<br \/><img decoding=\"async\" src=\"https:\/\/twt-thumbs.washtimes.com\/media\/image\/2025\/05\/15\/Medical_Examiner_Investigation_97621_s1440x960.jpg?f72536d07237fdd262042ae8f5e6e6de3b865f3c\" \/><\/p>\n<div>\n<p>The <a href=\"https:\/\/www.washingtontimes.com\/topics\/trump-justice-department\/\">Trump Justice Department<\/a> has sued to end <a href=\"https:\/\/www.washingtontimes.com\/topics\/maryland\/\">Maryland\u2019s<\/a> law that allows illegal immigrants to get in-state tuition rates, saying it violates a federal law that limits states\u2019 ability to grant that benefit to those in the country illegally.<\/p>\n<p><a href=\"https:\/\/www.washingtontimes.com\/topics\/maryland\/\">Maryland\u2019s<\/a> law, enacted in 2011, allows illegal immigrants who graduated from a school in the state, who attend a state college and whose parents have been paying taxes in the state to pay the same rates as legal state residents.<\/p>\n<p>Justice Department officials said that amounts to discrimination against U.S. citizens from other states \u2014 and it breaks a federal law to that effect.<\/p>\n<p>\u201cThis is a simple matter of federal law: Colleges cannot provide benefits to illegal aliens that they do not provide to U.S. citizens,\u201d said Assistant Attorney General Brett A. Shumate.<\/p>\n<p>The lawsuit also seeks to block <a href=\"https:\/\/www.washingtontimes.com\/topics\/maryland\/\">Maryland\u2019s<\/a> policy of allowing illegal immigrants access to scholarships and financial assistance.<\/p>\n<p><a href=\"https:\/\/www.washingtontimes.com\/topics\/maryland\/\">Maryland<\/a> Attorney General Anthony Brown denounced the lawsuit as an attack on the students.<\/p>\n<p>\u201cToday, the <a href=\"https:\/\/www.washingtontimes.com\/topics\/department-of-justice\/\">Department of Justice<\/a> sued to take away an opportunity from <a href=\"https:\/\/www.washingtontimes.com\/topics\/maryland\/\">Maryland<\/a> students who grew up here, graduated from school here, and are working to pursue something more for themselves, their families, and the communities in which they live,\u201d he said.<\/p>\n<aside>\n<\/aside>\n<p>The federal law says migrants who lack legal presence in the U.S. cannot claim residency in a state for tuition purposes unless the state also offers the same benefit to any citizen, regardless of residency.<\/p>\n<p>DOJ has filed similar lawsuits against 12 other states.<\/p>\n<p>Some of those cases have failed, such as in Minnesota, where a federal judge said that state\u2019s law was drawn to allow some U.S. citizens who attended school in the state but live outside state lines to get in-state tuition \u2014 so it doesn\u2019t run afoul of the federal prohibition.<\/p>\n<p>The federal government has appealed that decision.<\/p>\n<p>DOJ has also had some major successes.<\/p>\n<p>Earlier this month, the 5th U.S. Circuit Court of Appeals ruled that Texas\u2019s 25-year-old in-state tuition law violated the federal prohibition.<\/p>\n<p>Texas had agreed and reached a settlement nixing its law, but immigration groups had tried to intervene and defend the law.
