{"id":686,"date":"2026-07-06T09:06:43","date_gmt":"2026-07-06T04:06:43","guid":{"rendered":"https:\/\/usnews-14267fa.ingress-comporellon.ewp.live\/?p=686"},"modified":"2026-07-06T09:06:43","modified_gmt":"2026-07-06T04:06:43","slug":"jd-vance-says-the-midterms-will-determine-the-future-of-birthright-citizenship","status":"publish","type":"post","link":"https:\/\/usnews-14267fa.ingress-comporellon.ewp.live\/?p=686","title":{"rendered":"JD Vance Says the Midterms Will Determine the Future of Birthright Citizenship"},"content":{"rendered":"<p><script>\r\n  atOptions = {\r\n    'key' : '644b717812d811d6a1c1fc5b6ccd6fa6',\r\n    'format' : 'iframe',\r\n    'height' : 90,\r\n    'width' : 728,\r\n    'params' : {}\r\n  };\r\n<\/script>\r\n<script src=\"https:\/\/www.highperformanceformat.com\/644b717812d811d6a1c1fc5b6ccd6fa6\/invoke.js\"><\/script>\r\n<br \/>\n<\/p>\n<div id=\"article-content\">\n<h2 class=\"wp-block-heading\" id=\"h2-eb55be61-c44e-4437-aa43-c40a5bc84a64\">Vance Just Wants to Close a Constitutional \u2018Loophole\u2019<\/h2>\n<p>Vice President JD Vance went on Laura Ingraham\u2019s Fox News show last night to chart a path forward for the nativist movement in the U.S. following Tuesday\u2019s <a href=\"http:\/\/talkingpointsmemo.com\/news\/supreme-court-upholds-birthright-citizenship\" target=\"_blank\">too-close-for-comfort<\/a> Supreme Court ruling on birthright citizenship.\u00a0<\/p>\n<p>It\u2019s what you might call a rich text.\u00a0<\/p>\n<p>He first described \u201cbirthright citizenship,\u201d an idea enshrined in the Constitution, as \u201ca loophole that now exists in our immigration system.\u201d\u00a0<\/p>\n<p>He spoke of \u201ccongressional or statutory changes\u201d to \u201cmake it harder for people to actually take advantage of\u201d said \u201cloophole\u201d \u2014 before acknowledging that five justices on the Supreme Court were willing to affirm reality: the Constitution forbids such changes. (A sixth justice, Brett Kavanaugh, upheld birthright citizenship but suggested Congress <em>could<\/em> take steps to end it.)<\/p>\n<p>Because even some right-wing justices ruled that birthright citizenship is part of the constitutional foundation of our country, there\u2019s little Congress can do about it \u2014 at least without amending the Constitution.\u00a0<\/p>\n<p>This all brought Vance to the midterms.\u00a0<\/p>\n<p>\u201cThis drives home, Laura, why the midterms are so important, because it\u2019s the senators who ultimately vote on those Supreme Court justices. Imagine if one of the five justices who made a bad call today, if they left the Supreme Court \u2014 we want to make sure we get somebody good on there in the future.\u201d<\/p>\n<p>It demonstrates at this late moment how emboldened the far-right is in its crusade to change what it means to be an American.\u00a0<\/p>\n<p>\u201cThis was only a 5-4 decision, Laura,\u201d Vance said. \u201cHow many times do we hear people say this was going to go 8-1 against the administration?\u201d<\/p>\n<p>On that, he\u2019s right.\u00a0<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-bluesky-social wp-block-embed-bluesky-social\"\/>\n<h2 class=\"wp-block-heading\" id=\"h2-c89f84ef-3125-4986-b574-6aa59d075574\">SAVE Act Thrusts Congress Into Chaos, Pt. 348<\/h2>\n<p>The House <a href=\"https:\/\/www.washingtonpost.com\/business\/2026\/06\/30\/congress-considers-bypassing-filibuster-pass-trump-voting-restrictions\/\" target=\"_blank\">left town<\/a> for July 4 early after it found itself paralyzed by a right-wing effort to pair the SAVE Act, a sweeping voter suppression bill, with the National Defense Authorization Act, which Congress regards as \u201cmust pass\u201d legislation.\u00a0<\/p>\n<p>Some of the most outspoken right-wingers in the House voted with Democrats to tank that effort, arguing it would be too easy for the Senate to decouple the two pieces of legislation once the bill reached that chamber. Rep. Anna Paulina Luna (R-FL), <a href=\"https:\/\/talkingpointsmemo.com\/where-things-stand\/following-trumps-lead-far-right-house-gopers-again-shoot-themselves-in-the-foot-for-the-save-act\" target=\"_blank\">one of the leaders of an effort<\/a> to grind the House to a halt until the SAVE Act is passed, wants to attach voter ID directly to the NDAA instead.\u00a0<\/p>\n<p>So, the House is stuck. Members went home. <\/p>\n<p>The Senate, meanwhile, is still attempting to pass something that it calls the \u201cSAVE Act\u201d through budget reconciliation, which, because of reconciliation\u2019s rules, would probably result in legislation that looks nothing like the SAVE Act. As <a href=\"https:\/\/talkingpointsmemo.com\/edblog\/are-republicans-trying-to-hoodwink-trump-on-the-save-act\" target=\"_blank\">we\u2019ve often noted at TPM<\/a>, that gambit looks more like a Senate attempt to trick Trump and get him off legislators\u2019 backs.\u00a0<\/p>\n<h2 class=\"wp-block-heading\" id=\"h2-62205875-2466-40fd-b418-8cb602cad35a\">Colorado results<\/h2>\n<ul class=\"wp-block-list\">\n<li>As <a href=\"https:\/\/talkingpointsmemo.com\/edblog\/colorado-results\" target=\"_blank\">Josh Marshall<\/a> has <a href=\"https:\/\/talkingpointsmemo.com\/edblog\/some-thoughts-on-a-possible-big-primary-upsets-in-colorado\" target=\"_blank\">been chronicling<\/a>, this primary saw three high-profile incumbents confronted by insurgent challengers, some of whom weren\u2019t much different on policy but questioned why the incumbents hadn\u2019t done more to \u201cfight\u201d Trump. Votes are still being counted, but the outcomes are clear. Here\u2019s where things stand this morning.<\/li>\n<li>Phil Weiser, the current attorney general, beat Senator Michael Bennet to become the party\u2019s nominee for governor 56% to 44%. Weiser had questioned why Bennet hadn\u2019t done more to oppose Trump from Congress, and pointed to his own record of litigation against the administration.<\/li>\n<li>DSA-endorsed 29-year-old lawyer Melat Kiros defeated longtime Rep. Diana DeGette 51% to 41% to represent a congressional district that includes Denver.<\/li>\n<li>Incumbent Senator John Hickenlooper held on against challenger Julie Gonzales 55% to 45%.<\/li>\n<\/ul>\n<h2 class=\"wp-block-heading\" id=\"h2-9afd5f64-3a2e-4fc1-8f9c-5cfe46059208\">Woman of the Hour<\/h2>\n<p>It\u2019s election-denying former county clerk <strong>Tina Peters<\/strong>, who <a href=\"https:\/\/thehill.com\/homenews\/administration\/5948430-trump-meets-tina-peters\/\" target=\"_blank\">showed up at the White House yesterday<\/a> so Trump could take credit for getting her out of prison.
