But Google is pushing back against this judgment, and its reasoning is surprisingly sound.\u00a0<\/p>\n<p>The landmark decision places direct responsibility on upstream internet providers rather than on illegal streaming services, which are notoriously difficult to bring to justice in a local court, especially when they <a href=\"https:\/\/www.forbes.com\/sites\/wlf\/2020\/07\/30\/statutory-loophole-hampers-fight-against-large-scale-streaming-piracy\/\" target=\"_blank\" data-ga-click=\"1\" data-ga-label=\"$text\" data-ga-item=\"text-link\" data-ga-module=\"content_body\" title=\"(opens in a new window)\"><u>exploit loopholes in international law<\/u><\/a> or <a href=\"https:\/\/www.globalpatentfiling.com\/blog\/online-movie-piracy-combating--rogue--and--hydra-headed-rogue--websites\" target=\"_blank\" data-ga-click=\"1\" data-ga-label=\"$text\" data-ga-item=\"text-link\" data-ga-module=\"content_body\" title=\"(opens in a new window)\"><u>employ backup domains and servers<\/u><\/a> that go online when their main platforms are blocked.<\/p>\n<div class=\"flex mx-auto mt-8 w-full max-w-3xl font-sans text-lg leading-normal md:text-xl md:leading-7\">\n        <span class=\"font-bold text-primary-400\">SEE ALSO:<\/span><br \/>\n        <a href=\"https:\/\/mashable.com\/roundup\/best-vpns\" class=\"flex items-center text-secondary-300\"><br \/>\n            <span class=\"ml-1\">Worried about your digital privacy? To analogize, it&#8217;s a bit like trying to catch a minnow with a giant trawling net. It is disproportionate, catching lawful services, raising extra-territoriality concerns and blocking entire domains. Similarly, blocking IP addresses neither removes the content nor achieves proportionate outcomes, as many lawful services may be using the same IP address.&#8221;<\/p>\n<\/blockquote>\n<p>Google&#8217;s report goes on to cite real-world harms caused by these blanket bans, including inadvertently blocking Google Drive access and restricting access to websites such as Amnesty International, the ACLU, UNICEF, UNHCR, the Australian Senate, and Stanford Law Review.<\/p>\n<p>The Electronic Frontier Foundation has echoed Google&#8217;s criticisms, arguing that the EU&#8217;s attempts to legislate the internet &#8220;<a href=\"https:\/\/www.eff.org\/deeplinks\/2026\/07\/european-commission-chooses-keep-eu-users-locked-behind-big-techs-gates\" target=\"_blank\" data-ga-click=\"1\" data-ga-label=\"$text\" data-ga-item=\"text-link\" data-ga-module=\"content_body\" title=\"(opens in a new window)\"><u>keep EU users locked up behind big tech&#8217;s gates<\/u><\/a>.&#8221; The EFF also took a <a href=\"https:\/\/www.eff.org\/deeplinks\/2022\/05\/eus-copyright-directive-still-about-filters-eus-top-court-limits-its-use\" target=\"_blank\" data-ga-click=\"1\" data-ga-label=\"$text\" data-ga-item=\"text-link\" data-ga-module=\"content_body\" title=\"(opens in a new window)\"><u>strong stand against<\/u><\/a> the automated filtering mandates argued for in Article 13 of the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Directive_on_Copyright_in_the_Digital_Single_Market\" target=\"_blank\" data-ga-click=\"1\" data-ga-label=\"$text\" data-ga-item=\"text-link\" data-ga-module=\"content_body\" title=\"(opens in a new window)\"><u>EU Copyright Directive<\/u><\/a>.\u00a0<\/p>\n<p>It&#8217;s also looking like these concerns are coming to the United States, as a <a href=\"https:\/\/judiciary.house.gov\/subcommittees\/committee-judiciary-119th-congress\/courts-intellectual-property-artificial\" target=\"_blank\" data-ga-click=\"1\" data-ga-label=\"$text\" data-ga-item=\"text-link\" data-ga-module=\"content_body\" title=\"(opens in a new window)\">House IP <u>Subcommittee<\/u><\/a> met on June 30 to discuss exactly the kind of upstream content bans enforced by the EU. California Representative Darrell Issa has already <a href=\"https:\/\/thecapitolforum.com\/issa-to-unveil-anti-piracy-bill-this-week-yearslong-bipartisan-effort\/\" target=\"_blank\" data-ga-click=\"1\" data-ga-label=\"$text\" data-ga-item=\"text-link\" data-ga-module=\"content_body\" title=\"(opens in a new window)\"><u>pledged to introduce exactly such a bill<\/u><\/a>.\u00a0<\/p>\n<p>Not coincidentally, these legislative efforts are ramping up right as illegal streaming and downloading experiences a resurgence in popularity (a &#8220;<a href=\"https:\/\/www.theobserverumd.org\/post\/sailing-the-digital-seas-the-online-piracy-renaissance\" target=\"_blank\" data-ga-click=\"1\" data-ga-label=\"$text\" data-ga-item=\"text-link\" data-ga-module=\"content_body\" title=\"(opens in a new window)\"><u>Piracy Renaissance<\/u><\/a>,&#8221; according to one publication), perhaps not <em>in spite<\/em> of a massive spike in online streaming platforms but <a href=\"https:\/\/www.pcmag.com\/news\/internet-piracy-grows-amid-glut-of-streaming-services\" target=\"_blank\" data-ga-click=\"1\" data-ga-label=\"$text\" data-ga-item=\"text-link\" data-ga-module=\"content_body\" title=\"(opens in a new window)\"><em><u>because <\/u><\/em><u>of these platforms<\/u><\/a> and their ongoing efforts to <a href=\"https:\/\/mashable.com\/article\/every-streaming-app-price-increase-2026-so-far\" target=\"_blank\" data-ga-click=\"1\" data-ga-label=\"$text\" data-ga-item=\"text-link\" data-ga-module=\"content_body\"><u>raise prices<\/u><\/a>, <a href=\"https:\/\/mashable.com\/article\/netflix-ads-coming-end-of-2022\" target=\"_blank\" data-ga-click=\"1\" data-ga-label=\"$text\" data-ga-item=\"text-link\" data-ga-module=\"content_body\"><u>introduce advertising<\/u><\/a><u>,<\/u> and <a href=\"https:\/\/mashable.com\/article\/internet-tv-is-just-not-good-yet\" target=\"_blank\" data-ga-click=\"1\" data-ga-label=\"$text\" data-ga-item=\"text-link\" data-ga-module=\"content_body\"><u>fragment their content offerings<\/u><\/a>.\u00a0<\/p>\n<p>Expect this debate to heat up as more and more tech companies are pulled into the argument, and as the interests of internet giants like Google are pitted against the copyright claims of giant media broadcasters.<\/p>\n<section class=\"mx-auto max-w-7xl\">\n<\/section><\/div>\n<script async=\"async\" data-cfasync=\"false\" src=\"https:\/\/pl30214220.effectivecpmnetwork.com\/9ab3d4df8a7e1a6171e16ddbf732cc19\/invoke.js\"><\/script>\r\n<div id=\"container-9ab3d4df8a7e1a6171e16ddbf732cc19\"><\/div>\r\n\n","protected":false},"excerpt":{"rendered":"<p>A French court ordered upstream internet intermediaries like Google and Cloudflare to actively block access to prominent pirating and illegal streaming sites at the request of sports rights holders.
