{"id":43514,"date":"2026-08-14T04:09:57","date_gmt":"2026-08-13T23:09:57","guid":{"rendered":"https:\/\/usnews-14267fa.ingress-comporellon.ewp.live\/?p=43514"},"modified":"2026-08-14T04:09:57","modified_gmt":"2026-08-13T23:09:57","slug":"appeals-court-dodges-ruling-on-trumps-use-of-alien-enemies-act","status":"publish","type":"post","link":"https:\/\/usnews-14267fa.ingress-comporellon.ewp.live\/?p=43514","title":{"rendered":"Appeals court dodges ruling on Trump\u2019s use of Alien Enemies Act"},"content":{"rendered":"<p><script>\r\n  atOptions = {\r\n    'key' : '644b717812d811d6a1c1fc5b6ccd6fa6',\r\n    'format' : 'iframe',\r\n    'height' : 90,\r\n    'width' : 728,\r\n    'params' : {}\r\n  };\r\n<\/script>\r\n<script src=\"https:\/\/www.highperformanceformat.com\/644b717812d811d6a1c1fc5b6ccd6fa6\/invoke.js\"><\/script>\r\n<br \/>\n<br \/><img decoding=\"async\" src=\"https:\/\/media-cldnry.s-nbcnews.com\/image\/upload\/t_fit_1500w\/rockcms\/2026-08\/260813-U-8f8e21.jpg\" \/><\/p>\n<div>\n<p id=\"anchor-127680\" class=\"body-graf\">A U.S. appeals court dodged a decision Thursday on <a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\" target=\"_blank\">President Donald Trump\u2019s<\/a> contentious use of an obscure law called <a href=\"https:\/\/www.nbcnews.com\/politics\/politics-news\/trumps-effort-use-obscure-wartime-law-deport-venezuelans-fizzled-rcna353474\" target=\"_blank\">the Alien Enemies Act<\/a> to deport alleged Venezuelan gang members.<\/p>\n<p id=\"anchor-fe5a5c\" class=\"body-graf\">The judges dismissed the case because the Trump administration has now removed all three plaintiffs from the U.S. using alternative legal authorities.<\/p>\n<p id=\"anchor-fa94ad\" class=\"body-graf\"><a href=\"https:\/\/www.documentcloud.org\/documents\/28554362-aearuling\/\" target=\"_blank\">The ruling<\/a> by the New Orleans-based 5th U.S. Circuit Court of Appeals leaves the underlying legal question unresolved.<\/p>\n<p id=\"anchor-b055b1\" class=\"body-graf\">Last year, the Supreme Court blocked the government from immediately removing the alleged Tren de Aragua gang members without offering them any opportunity to challenge the move.<\/p>\n<p id=\"anchor-3de8a9\" class=\"body-graf\">Once the case returned to the appeals court in September, a three-judge panel <a href=\"https:\/\/www.nbcnews.com\/politics\/politics-news\/federal-court-blocks-trumps-removal-tren-de-aragua-members-wartime-ene-rcna228713\">ruled against Trump<\/a>, but the full 17-member court, considered the most conservative in the country, agreed to rehear the case in January at the administration\u2019s request.<\/p>\n<p id=\"anchor-4c70e5\" class=\"body-graf\">\u201cThis development is unobjectionable,\u201d Judge Jennifer Walker Elrod wrote Thursday of the deportations that render the case moot. \u201cThe Supreme Court expressly said that the government could remove the named petitioners and putative class under other laws. And petitioners point out no infirmities in their removal.\u201d<\/p>\n<p id=\"anchor-1a4469\" class=\"body-graf\">In reaching its decision, the court refused a request by lawyers for the plaintiffs to substitute new plaintiffs for the men who were deported.<\/p>\n<p id=\"anchor-168208\" class=\"endmark body-graf\">Thursday\u2019s ruling underlines how the administration\u2019s effort to invoke the Alien Enemies Act has largely fizzled.
