Max Miller\u2019s (R-Ohio) ex-wife, Emily Moreno, on Wednesday sued the Ohio Republican, alleging he published a nude photo of their young daughter online.<\/p>\n<p>A copy of the federal lawsuit obtained by The Hill alleges that Miller \u201crecklessly published and disclosed to the world a nude image\u201d of the child.<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\">\n<\/aside>\n<p>It says that Miller \u201crecklessly and intentionally\u201d gave the photo, as part of a Dropbox folder, to his lawyer Aaron Minc as part of a tranche of documents and photos \u201cto salvage his political job\u201d against Emily Moreno\u2019s claims of domestic abuse.<\/p>\n<p>Miller then posted a link to the Dropbox folder to the social platform X after a live stream defending himself.<\/p>\n<p>\u201cBut despite repeated requests from Ms. Moreno\u2019s counsel, Defendants have refused to provide information about how many times Defendents disclosed and transferred the intimate image to viewers who accessed, viewed or downloaded the intimate image,\u201d the suit reads. \u201cNor will Defendants answer questions about who might have accessed, viewed or downloaded the image.\u201d<\/p>\n<p>Moreno claimed in the lawsuit that more than 400,000 people accessed the Dropbox folder and says she said she never gave Miller or Minc consent to publish the images in the Dropbox.<\/p>\n<p>\u201cMiller\u2019s recklessness is underscored by the fact that any parent knows \u2014 in this era and world filled with pedophiles, creeps, and AI-generated image alteration and video generation \u2014 not to put nude pictures of their child, or any child, on the public internet,\u201d she wrote in the suit.<\/p>\n<p>Minc has taken responsibility for the images being made available to the public, <a href=\"https:\/\/www.politico.com\/live-updates\/2026\/08\/04\/congress\/max-miller-daughter-abuse-image-01023575\">telling Politico<\/a> that he was the \u201conly person responsible for assembling, creating, reviewing, adding, deleting, redacting, or making any changes to the information and files that were in this folder.\u201d<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\">\n<\/aside>\n<p>Miller and Moreno divorced last year and have been embroiled in a bitter custody battle over their daughter. Moreno has alleged Miller threw scalding water at her, held a gun to her head and may have broken their daughter\u2019s collarbone.<\/p>\n<p>The Ohio Republican <a href=\"https:\/\/thehill.com\/homenews\/house\/6009509-max-miller-domestic-abuse-drug-use-allegations\/\">has vehemently and repeatedly denied<\/a> allegations. He has vowed to remain in his reelection race despite calls to drop out or resign, including from Emily Moreno\u2019s father, Sen. Bernie Moreno (R-Ohio).<\/p>\n<p>\u201cWhen he went out and did what he did \u2014 including releasing photos of my granddaughter completely naked, that now you have hundreds of thousands of psychotic human beings that have that \u2014 and to say \u2018oops\u2019 is grotesque,\u201d the senator told reporters. \u201cMy personal opinion is that this is a felony, and that every single human being that touched that photo and transmitted it electronically should go to jail because it is illegal to do that.\u201d<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\">\n<\/aside>\n<p> Miller told CNN earlier this month that he will remain in the race for his seat, telling the network\u2019s Jake Tapper that he has \u201cthe utmost confidence that my constituents back home know me.\u201d<\/p>\n<p>Tapper <a href=\"https:\/\/www.cnn.com\/2026\/08\/04\/politics\/max-miller-image-child\" rel=\"noreferrer noopener\" target=\"_blank\">brought up the photo<\/a> during their interview, characterizing the act of sharing it as \u201cshockingly reckless behavior.\u201d Miller defended himself and said Minc \u201ctook full responsibility.\u201d<\/p>\n<p>\u201cI wouldn\u2019t say that it\u2019s shockingly reckless,\u201d Miller said.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr4_ab\">\n<\/aside>\n<p>The lawsuit requests that a judge find Miller and Minc\u2019s actions violated Ohio state and federal laws, award the daughter with $150,000 in damages and enter judgment in the daughter\u2019s favor to all claims of relief, among others.<\/p>\n<p>The Hill has reached out to Miller\u2019s campaign for comment.<\/p>\n<p>Sen. Jim Banks (R-Ind.) on Sunday became one of the latest members of Congress to react, calling the allegations against Miller \u201c<a href=\"https:\/\/thehill.com\/homenews\/senate\/6019150-jim-banks-max-miller-allegations\/\">deeply troubling<\/a>.\u201d<\/p>\n<aside class=\"ad-unit ad-unit--mr5_ab\">\n<\/aside>\n<p>The House Ethics Committee earlier this month <a href=\"https:\/\/thehill.com\/homenews\/house\/6008402-max-miller-ethics-committee\/\">launched a probe<\/a> into Miller after he filed paperwork to have the panel investigate him. The <a href=\"https:\/\/ethics.house.gov\/wp-content\/uploads\/2026\/08\/Press-Release-Rep.-Miller-8.4.26.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">committee said<\/a>\u00a0it was reviewing allegations of domestic violence and abuse or illegal drug use.<\/p>\n<\/div>\n<p>Copyright 2026 Nexstar Media Inc.
