It also accuses Meta\u00a0of\u00a0misleading the public about the mental and physical health risks and routinely collecting the data of users younger than 13 without parental consent.<\/p>\n<p>\u201cMeta has harnessed powerful and unprecedented technologies to entice, engage and ultimately ensnare youth and teens,\u201d the complaint stated.<\/p>\n<p>\u201cIt has concealed the ways in which these platforms exploit and manipulate its most vulnerable consumers: teenagers and children. And it has ignored the sweeping damage these platforms have caused to the mental and physical health of our nation\u2019s youth,\u201d it added.<\/p>\n<p>The complaint was originally filed by 29 states, but this month\u2019s trial will only cover the first four from California, Colorado, Kentucky and New Jersey.<\/p>\n<p>\u201cWe strongly disagree with these allegations and are confident the evidence will show our longstanding commitment to supporting young people,\u201d a spokesperson for Meta told The Hill Wednesday.<\/p>\n<p>\u201cWe\u2019ve listened to parents, worked with experts and law enforcement, and conducted in-depth research to understand the issues that matter most. We\u2019re proud of the progress we\u2019ve made, and we\u2019re always working to do better,\u201d they added.<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\">\n<\/aside>\n<p>An appeals court denied Meta\u2019s request to dismiss the case on Monday.<\/p>\n<p>Separately, the\u00a0<a href=\"https:\/\/thehill.com\/homenews\/6021367-social-media-safety-lawsuits-proceed\/\">court declined<\/a>\u00a0to drop the thousands of other online safety lawsuits against social media firms, ruling Meta and TikTok appealed the cases too early.<\/p>\n<p>In\u00a0<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ca9.0da58510-fa11-4f5e-9ef3-1b6255989102\/gov.uscourts.ca9.0da58510-fa11-4f5e-9ef3-1b6255989102.197.1.pdf\">an opinion<\/a>\u00a0issued Monday, the 9th U.S. Circuit Court of Appeals determined the technology liability shield \u2014 Section 230 of the Communications Decency Act \u2014 cannot be used by social media firms to dismiss lawsuits but only as a defense against claims.<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\">\n<\/aside>\n<p>Section 230, which protects technology companies from being held legally liable for third-party or user content, has largely shielded several firms from lawsuits related to content posted on their platforms.<\/p>\n<p>But the statute did not protect Meta in federal court earlier this year in California when a federal jury determined in March the company and YouTube were negligent in their design or operation of the platforms.<\/p>\n<p>The companies were ordered to pay a combined $6 million.<\/p>\n<aside class=\"ad-unit ad-unit--mr4_ab\">\n<\/aside>\n<p>The case, brought by a 20-year-old named K.G.M., consolidated thousands of lawsuits brought by individuals, school districts and states against multiple social media companies. Lawyers said K.G.M. became addicted to the platforms \u2014 prompting or worsening mental health issues.\u00a0<\/p>\n<p>Legal experts told The Hill at the time the case\u2019s targeting of platform design rather than the content posted to social media\u00a0makes it\u00a0easier for lawyers to get around Section 230 and other free speech arguments that typically arise with online content.<\/p>\n<p>The trial comes just days after a New Mexico court\u00a0<a href=\"https:\/\/thehill.com\/policy\/technology\/6016085-meta-youth-mental-health-new-mexico\/\">ordered Meta<\/a>\u00a0to pay an additional $567 million in the second phase of a state social media safety case.<\/p>\n<aside class=\"ad-unit ad-unit--mr5_ab\">\n<\/aside>\n<p>The order added to the $375 million in civil penalties Meta was\u00a0<a href=\"https:\/\/thehill.com\/policy\/technology\/5799252-meta-found-liable-children-safety\/\">ordered to pay<\/a>\u00a0in the first phase of the trial after a jury found the technology giant violated New Mexico\u2019s Unfair Practices Act.
