Kennelly of the Northern District of Illinois, according to the <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ca7.56888\/gov.uscourts.ca7.56888.34.0.pdf\">court\u2019s order<\/a>. Judge Kennelly, a Clinton appointee, ruled June 2 and formally entered the injunction June 8, finding Mr. Uthmeier\u2019s <a href=\"https:\/\/www.washingtontimes.com\/topics\/florida\/\">Florida<\/a> lawsuit was likely brought in bad faith to retaliate against the group\u2019s advocacy.<\/p>\n<p>Mr. Uthmeier sued the AAP, the World Professional Association for Transgender Health and the Endocrine Society in <a href=\"https:\/\/www.washingtontimes.com\/topics\/florida\/\">Florida\u2019s<\/a> 19th Judicial Circuit Court in December, alleging the groups violated the state\u2019s Deceptive and Unfair Trade Practices Act and its racketeering statute by promoting gender-transition procedures for minors as safe and reversible without adequate scientific support. He later added a <a href=\"https:\/\/www.washingtontimes.com\/topics\/florida\/\">Florida<\/a> antitrust claim. The AAP, in turn, sued Mr. Uthmeier in Illinois federal court, arguing the state action was First Amendment retaliation.<\/p>\n<p>A divided three-judge panel denied Mr. Uthmeier\u2019s request to stay the injunction on June 22, concluding he had not made the required strong showing that he was likely to prevail on appeal or would suffer irreparable harm while the appeal proceeded. Judge Michael Scudder dissented, calling the <a href=\"https:\/\/law.justia.com\/cases\/federal\/appellate-courts\/ca7\/26-2238\/26-2238-2026-06-22.html\">decision<\/a> \u201ca grievous blow to federalism.\u201d Indiana and 21 other states, joined by the Arizona Legislature, filed an <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ca7.56888\/gov.uscourts.ca7.56888.14.0.pdf\">amicus brief<\/a> backing Mr. Uthmeier\u2019s stay request.<\/p>\n<p>The full court\u2019s Wednesday order vacated that panel opinion and agreed to take up the case under a rarely invoked appellate rule permitting \u201cinitial hearing en banc.\u201d Five judges \u2014 Hamilton, Jackson-Akiwumi, John Lee, Doris Pryor and Nancy Maldonado \u2014 dissented from staying the injunction.
