But according to <em>The HOA Handbook<\/em>, \u201cthe primary goal is to encourage community-wide compliance with the agreed-upon rules, which protect property values and ensure a pleasant living environment for everyone.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The handbook states that rather than thinking of fines as a punishment, you should see them as a corrective measure. But for some of those on the receiving end, it\u2019s easier said than done. Especially when it\u2019s a nonsensical or stupid fine that amounts to thousands of dollars.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWhen a homeowner receives a fine, it\u2019s a direct consequence of a specific violation, like an unkempt lawn or unauthorized exterior modification,\u201d argues <em>The HOA Handbook<\/em>. It goes on to note that the fine system creates a \u201cfair and consistent\u201d method for addressing issues that affect the entire neighborhood\u2019s character and safety. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe financial aspect reinforces the seriousness of the community\u2019s covenants, conditions, and restrictions (CC&amp;Rs),\u201d it adds. Basically, if you plan to <a href=\"https:\/\/www.amazon.co.za\/Homeowner-Associations-Should-Before-Effective\/dp\/1450258425\" target=\"_blank\" class=\" staff-link\" rel=\"noopener nofollow\">buy property in a HOA<\/a>, you should be prepared to follow the rules.<\/span><\/p>\n<p>So where does the money collected from fines end up? It\u2019s<span style=\"font-weight: 400;\">\u00a0<em>almost always<\/em> funneled back into the community\u2019s general operating fund to benefit all homeowners collectively, claims the handbook.<\/span><\/p>\n<p>Your fines go towards paying for things like g<span style=\"font-weight: 400;\">eneral landscaping or common area maintenance, and r<\/span><span style=\"font-weight: 400;\">epair\/upkeep of community amenities like pools, clubhouses, and playgrounds. It may also be used to pay u<\/span><span style=\"font-weight: 400;\">tility bills for shared spaces, including lighting and irrigation. Or for a<\/span><span style=\"font-weight: 400;\">dministrative costs, such as postage and management software. Sometimes, fines are used to pay n<\/span><span style=\"font-weight: 400;\">eighborhood security services and\/or patrols.<\/span><\/p>\n<p><span class=\"post-desktop-ad-within-content post-ads margin-left\"\/><\/p>\n<p>According to legal experts, HOA fines are enforceable and are not illegal. However, <a href=\"https:\/\/www.realtor.com\/advice\/buy\/things-your-hoa-cant-do\/\" target=\"_blank\" class=\" staff-link\" rel=\"noopener nofollow\">says<\/a><span style=\"font-weight: 400;\"> real estate lawyer Barbara Jordan,\u00a0<\/span><span style=\"font-weight: 400;\">they \u201cmust be set forth in the association\u2019s rules and bylaws.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Jordan\u2019s advice is to check the community\u2019s CC&amp;Rs before complying.
