A <a href=\"https:\/\/fingfx.thomsonreuters.com\/gfx\/legaldocs\/znpnoolynvl\/08072026tps_burma.pdf\">similar decision followed<\/a> hours later by District Judge Matthew Kennelly of Chicago for migrants from Myanmar.<\/p>\n<p>TPS was created under the <a href=\"https:\/\/www.congress.gov\/bill\/101st-congress\/senate-bill\/358\">Immigration Act of 1990<\/a> \u2014 providing temporary, lawful immigration status in the U.S. for certain foreign nationals who are already in the country and are from countries to where the government has deemed returning unsafe.<\/p>\n<p>South Sudan received the TPS designation in 2011 due to the <a href=\"https:\/\/www.wgbh.org\/news\/local\/2025-12-30\/federal-judge-halts-end-of-protected-status-for-south-sudanese-migrants\">civil war<\/a> while Myanmar was <a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/11\/25\/2025-21069\/termination-of-the-designation-of-burma-myanmar-for-temporary-protected-status\">designated in 2021<\/a> based on \u201cextraordinary and temporary conditions.\u201d<\/p>\n<p>DHS initially attempted to end TPS protections for both countries in November, but at the time, Saris and Kennelly rejected the proposals. A <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5940351-supreme-court-temporary-protected-status-trump-immigration\/\">June Supreme Court decision<\/a> laid the groundwork for the federal judges\u2019 decisions, with justices then ruling to end TPS protections for migrants from Haiti and Syria.<\/p>\n<p>The high court ruled in a 6-3 decision, along ideological lines, that federal judges had no authority to weigh in on a challenge to TPS terminations \u2014 allowing federal authorities to continue.<\/p>\n<p>The loss of TPS will impact around 4,200 South Sudanese and Myanmar migrants, Reuters <a href=\"https:\/\/www.reuters.com\/legal\/government\/us-judge-allows-deportation-protections-end-south-sudanese-2026-08-07\/\" data-type=\"link\" data-id=\"https:\/\/www.reuters.com\/legal\/government\/us-judge-allows-deportation-protections-end-south-sudanese-2026-08-07\/\">reported<\/a>.<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\">\n<\/aside>\n<p>Myanmar is <a href=\"https:\/\/thehill.com\/homenews\/ap\/ap-international\/ap-myanmars-detained-former-leader-aung-san-suu-kyi-has-rare-meeting-with-red-cross\/\">still being led<\/a> by an army that overthrew the government and detained former leader Aung San Suu Kyi. In February, the United Nations <a href=\"https:\/\/apnews.com\/article\/un-south-sudan-violence-kiir-machar-election-5fe5cf3dbcbe4c8b140860e85fb04050\">warned that<\/a> South Sudan was on a \u201cdangerous precipice,\u201d as violence continued to escalate in the country.<\/p>\n<\/div>\n<p>Copyright 2026 Nexstar Media Inc.
