{"id":301,"date":"2026-07-05T18:26:35","date_gmt":"2026-07-05T13:26:35","guid":{"rendered":"https:\/\/usnews-14267fa.ingress-comporellon.ewp.live\/?p=301"},"modified":"2026-07-05T18:26:35","modified_gmt":"2026-07-05T13:26:35","slug":"the-supreme-court-let-trump-do-pretty-much-everything-he-wanted-except-mess-with-the-money","status":"publish","type":"post","link":"https:\/\/usnews-14267fa.ingress-comporellon.ewp.live\/?p=301","title":{"rendered":"The Supreme Court Let Trump Do Pretty Much Everything He Wanted \u2014 Except Mess with the Money"},"content":{"rendered":"<script>\r\n  atOptions = {\r\n    'key' : '644b717812d811d6a1c1fc5b6ccd6fa6',\r\n    'format' : 'iframe',\r\n    'height' : 90,\r\n    'width' : 728,\r\n    'params' : {}\r\n  };\r\n<\/script>\r\n<script src=\"https:\/\/www.highperformanceformat.com\/644b717812d811d6a1c1fc5b6ccd6fa6\/invoke.js\"><\/script>\r\n\r\n<br><div id=\"article-content\">\n            \n\n\n\n\n<p>You wouldn\u2019t know it from the right\u2019s ongoing social media tantrum, but the Supreme Court turned in another slate of decisions this term that gave Republicans nearly everything they wanted.\u00a0<\/p>\n\n\n\n\n<!-- \/wp:post-content -->\n\n<!-- wp:paragraph -->\n<p>The upholding of birthright citizenship \u2014 the <a href=\"https:\/\/talkingpointsmemo.com\/news\/republican-meltdowns-birthright-citizenship-supreme-court\" target=\"_blank\">cause<\/a> of much of the angst \u2014\u00a0was less a defeat for the right and more a revelation that four justices do not believe that everyone born on American soil automatically becomes a citizen under the 14th Amendment. Many court watchers anticipated a 9-0 ruling reinforcing the right, or at least a 7-2 with the typical crank allotment for Justices Samuel Alito and Clarence Thomas.\u00a0<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>But otherwise, the right-wing majority delivered on almost all of Trump\u2019s priorities: <a href=\"https:\/\/talkingpointsmemo.com\/news\/supreme-court-tps-haiti-syria\" target=\"_blank\">mass deportation<\/a>, <a href=\"https:\/\/talkingpointsmemo.com\/news\/scotus-officially-kills-precedent-that-protected-agencies-from-a-vengeful-president-but-with-special-federal-reserve-carveout\" target=\"_blank\">destruction of the administrative state<\/a> and <a href=\"https:\/\/talkingpointsmemo.com\/news\/alito-callais-voting-rights-act\" target=\"_blank\">giving Republicans an artificial electoral advantage<\/a>. The only major cases the Court decided against Trump, other than birthright citizenship \u2014 preventing him from firing a Federal Reserve governor and blocking tariffs \u2014 were ones in which a victory for the administration would existentially threaten the economy.\u00a0\u00a0<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Justice Brett Kavanaugh said as much in his concurrence in <em>Trump v. Cook<\/em>, which created a carveout in the Court\u2019s expansive view of executive power for the Federal Reserve: the Court, Kavanaugh explained, was preventing Trump from taking over the Fed now less for a legal reason and more because it didn\u2019t want to upend the global economy.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>\u201cLeaving that question open would create significant uncertainty about whether the Court might soon eliminate the Federal Reserve\u2019s independence, and thereby expose the Federal Reserve to political influences and jeopardize the efficacy of U.S. monetary policy,\u201d he wrote. \u201cEven temporary uncertainty about the status of the Federal Reserve could spark political upheaval, including confusion about whether the President could immediately remove multiple Governors at will, as well as turmoil in the U.S. and world economies.\u201d\u00a0<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>\u201cI would not risk destabilizing the U.S. economy just so that we can further mull over an issue that, in various permutations, we have been thinking about for many years,\u201d he added.\u00a0<\/p>\n<!-- \/wp:paragraph --><!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>The Fed case was the starkest, delivered at the same time as another Roberts-led majority in <em>Trump v. Slaughter<\/em>, which eliminated removal protections for agencies constituted like the Fed, but whose work the justices felt less compelled to preserve. Most of them are primarily regulatory bodies, including the Consumer Product Safety Commission, the Chemical Safety Board and the Nuclear Regulatory Commission.\u00a0<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>The preservation of the Fed\u2019s independence wouldn\u2019t be so stark if the Roberts Court hadn\u2019t so single-mindedly degraded the protections of every other independent agency in the executive branch, the better to funnel all the power to the presidency.\u00a0<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>\u201cPerhaps most strikingly, the Court today also makes clear that, whatever the logic of its decision, there are some ad hoc historical exceptions to its totalizing view of Article II, at least for the Federal Reserve,\u201d Justice Sonia Sotomayor wrote in her <em>Slaughter <\/em>dissent, adding: \u201cWhat is unclear is why these principles should be limited only to agencies, like the Federal Reserve, that in some respects influence \u2018monetary policy.\u2019\u201d<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>In the tariff case, <em>Learning Resources, Inc. v. Trump<\/em>, the Court also broke with its usual practices. Under Trump, it has nearly always enhanced the power of the presidency, molding the role in accordance with the unitary executive theory. That has manifested in the criminal immunity decision and the many rulings bringing executive agencies under the president\u2019s direct command.\u00a0<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>In <em>Learning Resources<\/em>, though, the Court ruled that Trump had gone too far.\u00a0<\/p>\n<!-- \/wp:paragraph --><!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>\u201c\u2026the Government reads IEEPA to give the President power to unilaterally impose unbounded tariffs and change them at will,\u201d Chief Justice John Roberts wrote for the majority. \u201cThat view would represent a transformative expansion of the President\u2019s authority over tariff policy.\u201d<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>He added that the tariffs \u201cextend beyond the President\u2019s \u2018legitimate reach.\u2019\u201d<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>As Sotomayor put it, this Court is willing to make \u201cad hoc exceptions\u201d to its war on executive branch agencies and creation of an all-powerful presidency.
