Ron DeSantis-backed law restricting children from certain sexually explicit live performances, including drag performances the state argues are obscene for minors.<\/p>\n<p data-layout-index=\"5\" class=\"speakable\">The full U.S. Court of Appeals for the 11th Circuit <a data-omtr-intcmp=\"fnc_politics_article_main-content_article-body_6_219770\" href=\"https:\/\/media.ca11.uscourts.gov\/opinions\/pub\/files\/202312160.enb.pdf\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">ruled Tuesday<\/a> 8-5 that Orlando restaurant Hamburger Mary\u2019s had not shown it was likely to succeed in its First and Fourteenth <a data-omtr-intcmp=\"fnc_politics_article_main-content_article-body_6_219771\" href=\"https:\/\/www.foxnews.com\/category\/us\/personal-freedoms\/first-amendment\" target=\"_blank\" rel=\"noopener\">Amendment<\/a> challenge to Florida\u2019s Protection of Children Act.<\/p>\n<p data-layout-index=\"5\">The court vacated the preliminary injunction in full and sent the case back to the <a data-omtr-intcmp=\"fnc_politics_article_main-content_article-body_6_219772\" href=\"https:\/\/www.foxnews.com\/category\/politics\/judiciary\/federal-courts\" target=\"_blank\" rel=\"noopener noreferrer\">U.S. District Court<\/a> for the Middle District of Florida for further proceedings. He also wrote that all three parts of the law\u2019s obscenity test must be met before a performance is prohibited.<\/p>\n<p data-layout-index=\"5\">The majority also ruled that using an age-variable standard did not make the law unconstitutional on its face.<\/p>\n<p data-layout-index=\"5\">Eight judges agreed that Hamburger Mary\u2019s was unlikely to succeed on the merits of its constitutional claims. Six judges joined Brasher&#8217;s opinion in full, while Judges Kevin Newsom and Britt Grant joined all but the section addressing universal injunctions.<\/p>\n<p data-layout-index=\"5\">Grant wrote separately that the court did not need to rule on the scope of the injunction after deciding that Hamburger Mary\u2019s was unlikely to succeed on the merits.<\/p>\n<p data-layout-index=\"5\">Five that the law forces venues to guess which performances are suitable for children of different ages while exposing operators to criminal penalties, fines and the possible loss of a business license.<\/p>\n<p data-layout-index=\"5\">&#8220;Today our Court embraces mess-around-and-find-out (\u2018MAFO\u2019) <a data-omtr-intcmp=\"fnc_politics_article_main-content_article-body_6_219779\" href=\"https:\/\/www.foxnews.com\/media\/gop-lawmakers-urge-supreme-court-strengthen-first-amendment-protections-street-preachers\" target=\"_blank\" rel=\"noopener noreferrer\">First Amendment jurisprudence<\/a>,&#8221; Rosenbaum wrote.<\/p>\n<p data-layout-index=\"5\">She argued that the law could chill protected speech by forcing businesses to risk prosecution before learning how officials would apply it.<\/p>\n<p data-layout-index=\"5\">Rosenbaum also argued that the statute effectively imposes strict liability over a child\u2019s age and could expose violators to jail, fines legislative history.<\/p>\n<p data-layout-index=\"5\">Abudu argued that comments from the law\u2019s supporters, along with warnings from legislative staff, supported Hamburger Mary\u2019s claim that the measure would chill protected drag performances.<\/p>\n<p data-layout-index=\"5\">The majority rejected that argument, writing that courts generally do not strike down an otherwise constitutional
