{"id":27337,"date":"2026-08-04T13:35:43","date_gmt":"2026-08-04T08:35:43","guid":{"rendered":"https:\/\/usnews-14267fa.ingress-comporellon.ewp.live\/?p=27337"},"modified":"2026-08-04T13:35:43","modified_gmt":"2026-08-04T08:35:43","slug":"democratic-states-urge-supreme-court-to-block-trumps-new-limits-on-mail-ballots","status":"publish","type":"post","link":"https:\/\/usnews-14267fa.ingress-comporellon.ewp.live\/?p=27337","title":{"rendered":"Democratic states urge Supreme Court to block Trump&#8217;s new limits on mail ballots"},"content":{"rendered":"<p><script>\r\n  atOptions = {\r\n    'key' : '644b717812d811d6a1c1fc5b6ccd6fa6',\r\n    'format' : 'iframe',\r\n    'height' : 90,\r\n    'width' : 728,\r\n    'params' : {}\r\n  };\r\n<\/script>\r\n<script src=\"https:\/\/www.highperformanceformat.com\/644b717812d811d6a1c1fc5b6ccd6fa6\/invoke.js\"><\/script>\r\n<br \/>\n<\/p>\n<div data-element=\"story-body\" data-dateline=\"\" data-subscriber-content=\"\">\n<p><span class=\"dateline\">WASHINGTON \u00a0\u2014\u00a0<\/span>California and 22 other Democratic-led states urged the Supreme Court on Monday to <a class=\"link\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/26\/26A139\/417979\/20260803142728267_Consolidated%20Opposition%20to%20Applications.pdf\" target=\"_blank\">block President Trump\u2019s plan<\/a> to take control of voting by mail through the U.S. Postal Service.<\/p>\n<p>They said it is too late in the election year to impose a new set of regulations for mail ballots. <\/p>\n<p>Doing so, they said, would lead to mistakes, including eligible and registered voters being told they are not on the federal government\u2019s approved list. <\/p>\n<p>\u201cBecause of the high risk of errors and the limited window for correcting mistakes, many of the millions of voters who rely on mail voting \u2014 especially voters with disabilities and those in rural areas \u2014 would likely be denied mail ballots and disenfranchised,\u201d they told the court. <\/p>\n<p>More broadly, they argued that the Constitution \u201centrusted the states and Congress \u2014 not the president \u2014 with the responsibility to set rules for federal elections.\u201d<\/p>\n<p>The justices are likely to act in a few days on whether to allow the Trump administration\u2018s plan to proceed pending the adoption of new and detailed guidelines. <\/p>\n<p>Last week, Trump Solicitor Gen. D. John Sauer sent an emergency appeal to the Supreme Court contending judges in Boston moved too quickly to halt the administration\u2019s new federal restrictions on voting by mail. <\/p>\n<p>He argued judges should stand back for now, even though the midterm elections are only three months away. <\/p>\n<p>Trump\u2019s executive order required the U.S. Postal Service to use state-by-state lists of eligible voters who may send a ballot by mail. <\/p>\n<p>Until now, states have had the constitutional authority to register voters for federal and state elections. And nearly a third of Americans now vote by mail. <\/p>\n<p>Trump, however, has insisted that voting by mail leads to fraud, including by allowing noncitizens to vote. <\/p>\n<p>Congress has refused to adopt new voting restrictions at Trump\u2019s behest. <\/p>\n<p>Instead, he issued an <a class=\"link\" href=\"https:\/\/www.latimes.com\/politics\/story\/2026-03-31\/trump-signs-executive-order-limiting-mail-in-ballots-california-leaders-say-theyll-fight\">executive order on March 31<\/a> to enlist the Postal Service and the Department of Homeland Security to ensure \u201ccitizenship verification and integrity in federal elections.\u201d<\/p>\n<p>The order called on Homeland Security  to compile state-by-state lists of citizens who are eligible to vote. And it told the postal service that it must use those lists to restrict who may vote by mail.<\/p>\n<p>\u201cThe USPS shall not transmit mail-in or absentee ballots from any individual unless those individuals have been enrolled on a State-specific list,\u201d the order said. <\/p>\n<p>But a federal judge and the 1st Circuit Court in Boston ruled Trump\u2019s new regulations may not be enforced this year, at least in the 23 Democratic-led states which sued. <\/p>\n<p>On Monday, they told the court that USPS delivered nearly 100 million mail ballots to or from voters in 2024, with roughly 30%  of all voters nationwide casting ballots by mail.<\/p>\n<\/p><\/div>\n<script async=\"async\" data-cfasync=\"false\" src=\"https:\/\/pl30214220.effectivecpmnetwork.com\/9ab3d4df8a7e1a6171e16ddbf732cc19\/invoke.js\"><\/script>\r\n<div id=\"container-9ab3d4df8a7e1a6171e16ddbf732cc19\"><\/div>\r\n\n","protected":false},"excerpt":{"rendered":"<p>WASHINGTON \u00a0\u2014\u00a0California and 22 other Democratic-led states urged the Supreme Court on Monday to block President Trump\u2019s plan to take control of voting by mail through the U.S. Postal Service.
