{"id":20934,"date":"2026-07-29T12:29:42","date_gmt":"2026-07-29T07:29:42","guid":{"rendered":"https:\/\/usnews-14267fa.ingress-comporellon.ewp.live\/?p=20934"},"modified":"2026-07-29T12:29:42","modified_gmt":"2026-07-29T07:29:42","slug":"how-the-supreme-court-deepened-uncertainty-over-temporary-protected-status","status":"publish","type":"post","link":"https:\/\/usnews-14267fa.ingress-comporellon.ewp.live\/?p=20934","title":{"rendered":"How the Supreme Court deepened uncertainty over Temporary Protected Status"},"content":{"rendered":"<p><script>\r\n  atOptions = {\r\n    'key' : '644b717812d811d6a1c1fc5b6ccd6fa6',\r\n    'format' : 'iframe',\r\n    'height' : 90,\r\n    'width' : 728,\r\n    'params' : {}\r\n  };\r\n<\/script>\r\n<script src=\"https:\/\/www.highperformanceformat.com\/644b717812d811d6a1c1fc5b6ccd6fa6\/invoke.js\"><\/script>\r\n<br \/>\n<br \/><img decoding=\"async\" src=\"https:\/\/images.axios.com\/ieha2Y7O2AogtSyI-zeIuHsZ8ko=\/0x0:1920x1080\/1366x768\/2026\/02\/17\/1771355192055.jpeg\" \/><\/p>\n<p>Legal protections for hundreds of thousands of <a href=\"https:\/\/www.axios.com\/local\/miami\/2026\/07\/24\/florida-miami-tps-haiti\" target=\"_blank\">Haitians<\/a> and <a href=\"https:\/\/www.axios.com\/local\/boston\/2026\/06\/25\/supreme-court-massachusetts-tps-haiti\" target=\"_blank\">Syrians<\/a> in the U.S. have ended after the Supreme Court upheld the termination of their Temporary Protected Status, a ruling that could reshape the program&#8217;s future.<\/p>\n<p><strong>The big picture: <\/strong>The <a href=\"https:\/\/www.axios.com\/politics-policy\/supreme-court-legal-decisions\" target=\"_blank\">justices<\/a> limited courts&#8217; ability to review Homeland Security&#8217;s TPS decisions \u2014 making challenges harder and leaving hundreds of thousands of people at risk of losing legal status, work authorization and protection from deportation.<\/p>\n<hr>\n<ul>\n<li>Established in 1990, TPS protects nationals of <a href=\"https:\/\/www.axios.com\/local\/columbus\/2026\/07\/01\/mayor-ginther-tps-supreme-court-ruling\" target=\"_blank\">designated countries<\/a> fleeing extraordinary circumstances.<\/li>\n<li>&#8220;The ripple effects of this are going to be really big&#8221; and &#8220;really impactful for not only the <a href=\"https:\/\/www.axios.com\/politics-policy\/immigration\" target=\"_blank\">TPS<\/a> holders themselves, but for everyone in their communities,&#8221; says Esther Sung, the Justice Action Center&#8217;s legal director.<\/li>\n<\/ul>\n<p><strong>State of play: <\/strong>The Trump administration has moved to <a href=\"https:\/\/www.axios.com\/2025\/11\/24\/trump-immigration-temporary-protected-status-myanmar-burma-somalia\" target=\"_blank\">end TPS<\/a> for nationals of more than a <a href=\"https:\/\/www.nytimes.com\/2026\/04\/29\/us\/politics\/which-countries-have-tps.html\" target=\"_blank\">dozen<\/a> countries, complicating legal challenges after the high court&#8217;s decision.<\/p>\n<ul>\n<li>At the start of President <a href=\"https:\/\/www.axios.com\/politics-policy\/donald-trump\" target=\"_blank\">Trump&#8217;s<\/a> term, per the American Immigration Council, around 1.3 million people had TPS. Since then, hundreds of thousands have lost TPS protections.<\/li>\n<\/ul>\n<p><strong>What they&#8217;re saying:<\/strong> DHS pointed Axios to government webpages on TPS, said recipients without another lawful immigration status will be subject to deportation &#8220;once TPS ends,&#8221; and urged them to use the administration&#8217;s self-deportation app.<\/p>\n<ul>\n<li>&#8220;If people want to come to our country to work, they need to do that by coming here the legal way,&#8221; a DHS spokesperson said Tuesday, rejecting the argument that ending TPS would hurt industries including health care, construction, logistics and restaurants.<\/li>\n<li>USCIS spokesperson Zach Kahler said DHS was &#8220;upholding the rule of law&#8221; and argued the Biden administration improperly used TPS to extend protections beyond the program&#8217;s intended scope.<\/li>\n<\/ul>\n<p><strong>Yes, but: <\/strong>The revocations are &#8220;absolutely without precedent, by huge orders of magnitude of any sort of revocation of status in the modern immigration system,&#8221; says FWD.us president Todd<em>\u00a0<\/em>Schulte.<\/p>\n<ul>\n<li>Advocates warn the terminations could deliver an economic blow. Roughly 80% of TPS holders participated in the labor market, per a 2025 Penn <a href=\"https:\/\/budgetmodel.wharton.upenn.edu\/p\/2025-11-19-550-000-workers-lose-status-by-end-of-2025\/\" target=\"_blank\">study<\/a>. <\/li>\n<li>&#8220;I think people are going to really want to know why it is that the person who was their kid&#8217;s teacher, the person who was a parent in their kids&#8217; classroom, left or got taken \u2014 or the healthcare worker, or the construction worker, the accountant,&#8221; Schulte says.<\/li>\n<\/ul>\n<p><strong>What we&#8217;re watching:<\/strong> TPS designations for nationals of other countries are also moving toward possible expiration. <\/p>\n<ul>\n<li>That includes protections for some <a href=\"https:\/\/www.fwd.us\/wp-content\/uploads\/2026\/07\/2026-FWD_TPSforElSalvador.pdf\" target=\"_blank\">170,000<\/a> Salvadorans, valid through <a href=\"https:\/\/www.uscis.gov\/humanitarian\/temporary-protected-status\/temporary-protected-status-designated-country-el-salvador\" target=\"_blank\">Sept. 9<\/a> but potentially ending after over <a href=\"https:\/\/suozzi.house.gov\/media\/press-releases\/suozzi-seeks-extension-temporary-protected-status-tps-el-salvador\" target=\"_blank\">two decades<\/a>.<\/li>\n<li>&#8220;I don&#8217;t have high hopes for TPS for any of the designated countries under this administration,&#8221; Sung says.<\/li>\n<\/ul>\n<p><strong>Zoom out<\/strong>: Litigation over TPS terminations in Burma, Ethiopia, South Sudan and Somalia is ongoing, with challengers regrouping following SCOTUS&#8217; decision.<\/p>\n<ul>\n<li>Last week, U.S. District Judge Brian Murphy temporarily delayed the termination of protections for Ethiopians, a move DHS general counsel, James Percival, <a href=\"https:\/\/x.com\/DHSGenCounsel\/status\/2080738489335742966\" target=\"_blank\">framed<\/a> as &#8220;mutiny against the Supreme Court.&#8221; <\/li>\n<li>But American Immigration Council senior fellow Dara Lind tells Axios: &#8220;The TPS challenges that are still working their way through the courts, even potentially future TPS terminations &#8230; are going to have to meet a standard that the previous lawsuits haven&#8217;t.&#8221;<\/li>\n<\/ul>\n<p><strong>Zoom in:<\/strong> &#8220;TPS recipients are survivors,&#8221; says Chris Newman, legal director for the National Day Laborer Organizing Network.
