The conditions would also allow DHS to terminate grants at anytime and for any reason.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">\u201cOnce again, the Trump Administration is threatening to jeopardize public safety by unlawfully withholding billions in critical funding and once again, they won\u2019t get away with it,\u201d Rhode Island Attorney General Peter Neronha said. \u201cThis Administration is using the safety of Americans as collateral by attempting to bully the states into relinquishing their constitutional right to enact policies and laws that best serve their residents.\u201d<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">The states argue putting conditions on congressionally appropriated funding violates the Administrative Procedure Act and the U.S. Constitution\u2019s spending clause. A spokesperson for the Department of Homeland Security did not immediately respond to a request for comment.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">The lawsuit is one of scores that have challenged the Trump administration over its repeated effort to browbeat mostly Democrat states into complying with its priorities to get billions of dollars in federal funding. The strategy has been used on everything from education funding to domestic violence grants to <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/ice-immigration-lawsuit-sean-duffy-e386d0f659e49fe57a02edeafb1da6da\">highway funding<\/a>. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">The courts have repeatedly found this strategy to be unlawful and unconstitutional. A ruling last year barred the administration from putting conditions on other FEMA funding and a second ruling this year blocked the administration from redirecting DHS funding away from states not seen as supportive to the its agenda.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">\u201cThe States face losing billions of dollars in federal funding, are being put in a position of relinquishing their sovereign right to decide how to use their own police officers, are at risk of losing the trust built between local law enforcement and immigrant communities, and will have to scale back, reconsider, or cancel ongoing transportation projects,\u201d U.S. District Judge John McConnell Jr. wrote last year, when he barred the Transportation Secretary Sean Duffy from cutting off transportation funds to states that did not comply with immigration enforcement actions.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">The latest lawsuit argues the administration is attempting to apply some of the same conditions on 2026 funding, as it failed to do with funding last year. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Among the requirements being challenged in Thursday&#8217;s lawsuit is that states change their <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/trump-executive-order-elections-mail-voting-b28c3425c1dc968cd0f57c61fb7a684e\">elections systems.<\/a> They must transition to paper-ballot systems, conduct a manual audit of voting systems, reconcile voters and verify the citizenship of every registered voter in the state\u2019s voter databases. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">If states fail to comply, they risk losing at least 20% of their Homeland Security Grant Program funding. That money is used to fund measures to protect citizens from cyberattacks and terrorism.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC eTIW sUzSN \">Since his 2020 presidential election <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/election-claims-biden-won-explained-bd53b14ce871412b462cb3fe2c563f18\">loss to Democrat Joe Biden<\/a>, Trump has groundlessly claimed mail voting is rife with fraud and has <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/trump-special-prosecutor-2020-biden-election-194b3d49f49b0345f77873fc34b4dcc5\">launched a federal investigation<\/a> into that year\u2019s vote, even though <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/joe-biden-wisconsin-presidential-elections-state-elections-madison-9a2f172dd8074668ded26bd5b0b41fbb\">repeated audits and investigations<\/a>, including <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/donald-trump-joe-biden-election-2020-elections-government-and-politics-4b6643aa699480dc63cbce8555aac946\">ones run by Republicans<\/a>, found it was <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/elections-government-and-politics-nevada-ed4d5296d9fd7fd9afd83a3fe845c205\">free of widespread fraud<\/a>.
